(1) Where can a person obtain information on which psychiatrists are members of the Panel?
The list of appointed psychiatrists will be published on the website after the Panel operationalises.
(2) What happens if a person engages a psychiatrist who is not or ceases to be a member of the Panel?
If the psychiatrist was a member of the Panel at the time his expert evidence was adduced in the criminal proceedings, his expert evidence would be admissible, even if he ceases to be a member of the Panel thereafter. However, the court may determine the weight that should be given to the psychiatrist’s evidence, after considering all the circumstances of the case.
If the psychiatrist was not a member of the Panel at the time his expert evidence was adduced in the criminal proceedings, his expert evidence will not be admissible.
